OUR COSTS

Some road traffic cases are ones for which you may be entitled to representation via a legal aid order. If the case met the interests of justice test (IE it was deemed serious enough for you to be granted legal aid) and you passed the means test (IE that you were in receipt of certain benefits or your income and capital are below certain levels) the legal aid may be granted. If not then we could represent you on the basis that you paid privately. The costs of the case will depend on certain factors.

Straightforward Road Traffic Cases

These would be cases which were classed as straightforward in terms of the issues. For example a drink driving case where the issues was whether or not you were the driver or a no insurance case where you had been misled into believing you had insurance and therefore wished to put forward an argument of special reasons to the Court to avoid your driving licence being endorsed.

The fee will include the following:

  • Taking your instructions and considering the available evidence
  • Advice on any defences, plea, likely sentence and issues such as whether special reasons or exceptional hardship exist
  • Representation at Court
  • Pre-Court work necessary to prepare your case.

The fee does not include the following:

  • Instruction of any expert witnesses
  • Taking statements from any witnesses
  • Advice or assistance in relation to any appeal

Guilty Plea = £250 + VAT

Not Guilty Plea = Between £400 – £1200 + VAT (this is dependent on various issues such how long the trial will last and the number of witnesses)

More Complex Road Traffic Cases

This could include offences where there are complex issues such as BAC calculations in drink drive cases, or drink drive cases where there is a high reading or significant aggravating factors which may increase the risk of custody. Other offences involving a technical issue may increase the complexity of a case such as no insurance matters where there is a defence relating to the use of a vehicle for employment.

The fee will include the following:

  • Taking your instructions and considering the available evidence
  • Advice on any defences, plea, likely sentence and issues such as whether special reasons or exceptional hardship exist
  • Instruction of any required expert witness
  • Representation at Court
  • Pre-Court work necessary to prepare your case.

The fee does not include the following:

  • Advice or assistance in relation to any appeal

Guilty Plea = £400 + VAT

Not Guilty Plea = £700 – £2000 + VAT. We would expect the average fixed fee for a high complexity not guilty trial to be £1500 + VAT. However please note the complexity factors listed below which will be taken into account when determining the final cost. One of the factors which may effect the final price is the instruction of an expert witness.

Issues which may increase the price of a more complex road traffic case include, but are not limited to:

  • Whether expert or medical evidence is required to assist your case
  • Whether the prosecution case involves expert or medical evidence.
  • Whether the case against you involves an allegation that you have caused injury or death or serious damage
  • The number/nature of witnesses
  • Whether you are charged with more than one offence
  • High readings for drink or drugs or high speeds

Please note the above fees do not cover costs such as expert witness reports. If we feel an expert report is necessary or would be beneficial we would discuss that with you and obtain quotes for the likely cost before committing you to the expenditure as the costs can wildly vary dependent upon the nature of the report required.
